TERMS OF SALE

By placing an order through the New Farm Deli website, you are making an offer to purchase products in accordance with our Terms & Conditions. All orders are subject to availability and confirmation of price at the time of processing.

You confirm that all information provided for your order is true and accurate, and that you are authorised to use the payment method supplied.

PRODUCT PRICING 

Product prices are subject to change at any time due to ongoing increases in supplier costs, which can fluctuate based on a variety of factors such as raw material shortages, transportation fees, or changes in market conditions. As a result, the price of your order may vary from the initial quotation, and any price difference may be requested upon completion of the order. We strive to keep our pricing transparent, but please be aware that these adjustments are sometimes necessary to reflect the current market dynamics.

ELIGABILITY TO PURCHASE

To place an order via our website, you must:

  • Provide accurate personal and billing information

  • Be the authorised holder of the credit or debit card used for payment

  • Be legally eligible to enter into a binding contract under Australian law

We reserve the right to decline or cancel any order at our discretion, including where multiple units of the same item are requested, where fraud is suspected, or where payment details cannot be verified.

HOT TO PLACE A CATERING ORDER​

All our catering is made fresh to order and therefore all orders are to be placed with a minimum of ONE FULL BUSINESS DAY notice before required pickup.

Please note that all catering orders are to be picked up no earlier than 9am each morning, and all hot and ready to serve orders to be picked up no later than 4pm.  The cold itemed orders can be picked up anytime from 9am until close daily.

When placing your order online, please specify in the notes section whether you would like to collect your catering hot and ready to serve or cold and ready to reheat at your convenience.

If you are placing an order for a larger group, we strongly recommend you order over the phone or in store so that we may assist you with suitable quantities to serve your guests.

REFUND & RETURNS POLICY

(FOR ALL ONLINE ORDERS EXCL. CATERING)​

If for any reason you are not completely satisfied with your purchase we will give you a seven day money-back guarantee from the time you receive the goods.

 

Please email us at gourmet@newfarmdeli.com.au within that time if you are not satisfied with your purchase so that we can resolve any problems.

This refund policy does not apply to goods which have been opened or damaged after delivery, or if any attempt has been made to alter the product or if they have been dropped or broken.

All products must be returned in their original condition.

​

All postage and insurance costs are to be paid by the buyer. We recommend that you return the product via Registered post and that you pre pay all postage. You assume any risk of lost, theft or damaged goods during transit & therefore advise you take out shipment registration of insurance with your postal carrier.

New Farm Deli will not be responsible or parcels lost or damaged in transit if you choose not to insure.

CHANGE OR CANCELLATION OF ORDER
(FOR ALL ONLINE ORDERS)​

Cancellations for catering, cakes, and hampers are accepted up to two days prior to the scheduled collection or delivery date. If a cancellation is made within this notice period, customers have two options:

  • Request a store credit for the full value of the order (no administration fee applied), or

  • Receive a refund, less a 20% administration fee.

 

Cancellations made less than two days before the scheduled date are not eligible for a refund, but a store credit may be offered at the discretion of New Farm Deli management, depending on the production status of the order.

Modifications to existing orders – including changes to items, quantities, or collection/delivery dates – must also be submitted at least two days before the order date, provided the product lead time allows. A “modification” is defined as any adjustment to the products ordered or their scheduled fulfilment. Changes requested after this period may be considered on a case-by-case basis, but are subject to management approval.

If a requested change cannot be accommodated due to timing, the specific item may be cancelled and a store credit for the full value issued. Refunds will not be offered in these cases. If a customer wishes to cancel the entire order, the standard cancellation policy (outlined above) will apply.

Requests to reschedule an order made less than two days before the due date may be possible, depending on production capacity, and are subject to approval by New Farm Deli’s kitchen and management team.

PRODUCT INFORMATION

At New Farm Deli, we aim to provide accurate and detailed descriptions of all our products. However, we cannot guarantee that every product description or other information on our website is always completely current, reliable, or error-free. While many of the products featured online are available in-store, there may be instances where certain items are unavailable or out of stock.

ALLERGY AND INTOLERANCES

We take allergens seriously and do our best to label products clearly. However, all of our products are prepared in a kitchen where common allergens are handled. This includes (but is not limited to) nuts, seeds, eggs, gluten, wheat, soy, dairy, and alcohol. As a result, trace elements of allergens may be present in any item.

If you have any allergies or dietary requirements, we recommend speaking directly with our team in-store before placing your order. Your safety is important to us at New Farm Deli, and we’re always happy to help guide your selection.

PRODUCT APPEARANCE AND COLOUR VARIATION

We strive to represent our products as accurately as possible through photos and descriptions. However, due to differences in monitor settings, colours may appear slightly different on screen. Additionally, as our items are handcrafted using natural ingredients, there may be slight variations in appearance, colour, or finish between batches.

GOVERNING LAW AND DISPUTE RESOLUTION

Any disputes may be resolved through confidential arbitration in Brisbane, Queensland, unless the matter involves intellectual property rights, in which case New Farm Deli reserves the right to pursue legal remedies through the courts. You agree to exclusive jurisdiction in Queensland courts for such matters.

To the maximum extent permitted by law, no arbitration under these terms shall be joined to another party's arbitration, whether as a class action or otherwise.

 

INDEMNITY

By using this site, you agree to indemnify and hold harmless New Farm Deli, its staff, management, and affiliates from any claims, demands, losses, liabilities, damages, or expenses (including legal fees) arising out of your use of the website or your breach of these terms and conditions.
